Resident Mark Denick, 10813 West 134th Place, told the Stormwater Board during public comment that a neighboring property (13465 Osborne) has filled and obstructed a recorded drainage easement and installed a wooden planter he described as a 14‑inch dam. Denick said the obstruction has backed water into his yard since 2020, forced him to spend roughly $5,000 to raise a shed and caused recurring settlement damage.
Denick provided plats, photographs and referenced earlier Stormwater Board meetings in 2020 where the board discussed restoring the swale and directed remediation. He said town staff scraped some material in 2020 but the homeowner later reinstalled vegetation and structures that impede flow. Denick urged enforcement under the town’s stormwater ordinance, which he cited as prohibiting placement of objects that retard flow in easements.
Chair and other members acknowledged the easement on record and asked Wendy to notify code enforcement. The board instructed staff to attempt enforcement and, if no action occurs, to return with a plan to clear the easement (including renting or using a wheeled excavator) and to keep the matter on the agenda until resolved. Denick asked for contact information and said he would provide documentation and footage to staff.
The board did not take enforcement action at the meeting but committed to follow up before the next meeting.
