Ocean Pines board forwards violations to legal and approves contractor tree removal charged to owner

At its April meeting the Ocean Pines Association Board approved two enforcement actions: forwarding several properties with unresolved CPI violations to legal with a recommendation to suspend amenity and voting rights, and authorizing contractor removal of a dangerous tree at 1034 Ocean Parkway with the cost assessed to the property owner.

Linda, the staff member reporting on CPI enforcement, told the board there were “39 new violations, 31 closed” and that “58 of the 127 are still illegal,” and recommended forwarding cases where no hearing was requested to legal and suspending amenity and voting privileges for noncompliance. The board voted to move the listed violations to legal and to suspend rights, with the chair calling the motion and members responding by voice vote.

On a separate item Linda said the tree at 1034 Ocean Parkway posed danger and recommended contractor removal. Bruce offered a modification noting that the cost should be added to the property owner’s assessment bill; the chair restated the motion to hire a contractor to remove the tree and pass the expense to the owner. The motion was seconded and passed by voice vote.

Monica (Treasurer) confirmed that notices and pre-violation steps had been followed in the cases discussed. The transcript shows the board documenting that staff had contacted property owners, issued first and second notices, and provided opportunities to respond before advancing cases to legal.

The board did not record a roll-call vote in the transcript; the motions were passed by voice vote and the meeting proceeded to other business.
