Staff said the operator holds a County food preparation permit, a City of Shafter business license, and property-owner permission to operate in the parking lot. Staff told the commission the vendor has operated in good standing for eight years and recommended adopting a notice of exemption under CEQA and Resolution No. 26-487 to extend the temporary permit for one year.
Staff explained that under Title 17 (zoning ordinance) the commission may extend a temporary land use permit up to four times and that, if approved, this would be the third extension for this operator, leaving one additional extension available. Staff and commissioners discussed whether the ordinance should be revised so that some longstanding mobile vendors in good standing would not be required to renew annually; staff said such a change would require a formal amendment to the zoning ordinance.
Commissioner Sanchez moved to adopt Resolution No. 26-487; Commissioner Simmons seconded. Roll-call votes were recorded in the transcript as 'Aye' from Commissioners Sanchez, Heizer and Simmons and from the member referred to as Joshan; the motion passed as recorded.
Staff also confirmed there are currently two similar mobile vendors operating with this sort of temporary permit in town. No public speakers were recorded on this item.
