The Kuna Joint District Board of Trustees voted to accept the city’s offer for the 4th Street gym that sets a five‑year vacate term and imposes liquidated damages of $10,000 per day for any day the district remains on the property beyond the agreed date.
Assistant Superintendent Brian Graves summarized the city’s proposal, saying, “It would only apply if the property is not vacated at the end of our 5 year term. Specifically, the provision establishes liquidated damages of $10,000 per day for any day during which the property remains occupied beyond that 5th year agreed upon vacate date.” Graves said the district can also vacate earlier and that staff will bring a formal timeline and finance plan to trustees for approval.
Trustees raised concerns about exposure to the penalty and emphasized the need for an internal vacate target and contingency sites if construction or other delays intervene. One trustee asked whether HB 25 funds might be used “to cover cost upfront” while the district finalizes the arrangement; staff said they would present specific budgeting options. Another trustee said the $10,000 figure “seems kinda harsh,” prompting discussion of contingency language and internal deadlines to avoid the penalty.
Speaker 2 moved to accept the city’s offer as presented; Speaker 3 seconded. The board voted in favor, and the chair said the next step would be to join the mayor before city council as part of the final approval process.
The decision directs staff to return with a timeline and a finance plan that lays out how the district will pay for relocation or related construction, and to coordinate the district’s presentation with the mayor at city council.
