The Tulare County Flood Control District voted to ask the Tulare County Board of Supervisors to authorize remote teleconferencing for the commission and adopted a resolution declaring the Susan Simon seat vacant.
County staff explained that, under recent Brown Act guidance, the commission may ask the Board of Supervisors to permit members to participate remotely by adopting a Board resolution that must be renewed every six months. A county staff member said the body must post agendas, provide an interactive platform (such as Zoom or Teams), require remote members to be on camera and disclose any adults present in the remote location when voting. "That resolution has to be adopted every 6 months," the staff member said.
A committee member moved that the commission request Board authorization; another commissioner seconded the motion and the commission approved it by voice vote. Staff said it will prepare the agenda item for the Board of Supervisors and will return with any additional steps the commission must take after Board action.
On bylaws, staff described a newly added procedure allowing the commission to declare seats vacant when a commissioner ceases to be a county resident. The commission adopted a resolution declaring the seat held by Susan Simon vacant after staff said Simon moved out of county. The commission also discussed a separate attendance-triggered vacancy for Commissioner Jackson but "shelved" that resolution and took no action.
Staff asked commissioners to sign the adopted resolutions before leaving so the clerk can process them and declare the vacancy. The commission set the next meeting for Oct. 21, 2026, and adjourned.
What happens next: staff will prepare an item for the Board of Supervisors to consider authorizing remote attendance; the Simon vacancy will be transmitted to the Board for appointment or other action per county process.
