The Silver Spring Township Zoning Hearing Board on June 8 partially granted a variance for a shed at 3 Pheasant Street, approving some requests and denying others after hearing testimony from the applicant and nearby residents.
Lois Jane Hoy, the applicant and owner, sought relief from Section 204.C of the Silver Spring Township Zoning Ordinance to reduce side and rear yard setbacks for an accessory structure and to exceed the R-1 district’s maximum impervious coverage of 35 percent to accommodate a proposed shed. Chelsea Leiby, the township’s zoning hearing officer, confirmed that required legal notices were published and posted.
Neighbor Maynard Bertolet testified in opposition, saying the shed would sit directly next to his fence. Another resident, William Zelner, spoke in support of the application, noting the generally small lot sizes along Pheasant Street.
After retiring to an executive session for quasi-judicial deliberations, the board returned and Vice-Chairman Richard Maffett moved, with Darrell McMillan seconding, to approve the application in part and deny it in part. The board approved the motion unanimously. The board did not specify in the minutes which specific elements were approved and which were denied; the record notes the split decision only.
