Staff said the developer provided a signed letter from Braun Intertech (principal engineer Ezra Bollinger) documenting geotechnical testimony previously given to council and submitted an updated plat that uses the watercourse bank line instead of the river center line. The agreement also reflects a change in the owner/developer entity name and includes exhibits that show park-dedication payment arrangements and an updated private infrastructure section consistent with the councils recently adopted policy.
Council members confirmed the geotech documentation, the attached exhibits and that Jims office will retain discretion to review and approve improvement plans. A motion to approve the developer's agreement was seconded and carried by voice vote.
Next steps: staff will finalize exhibits and execute the agreement, and the developer will coordinate improvement plans and inspection responsibilities with the city engineer's office.
