The Brian Head Town Council on June 23 adopted an amendment to the Land Management Code (Chapter 7) to permit a residential dwelling within a commercial building envelope when the unit is for an owner or an employee/caretaker.
Planning & Building Administrator Greg Sant told the Council the change addresses an inconsistency: the Light Industrial zone already allows a small on-site residential unit for an owner or caretaker, but the General Commercial zone did not. The amendment adds "residential dwelling within a commercial building envelope for owner/employee housing" as a permitted use in the General Commercial zone and is explicitly not intended to allow standalone residential development or general rental units.
Council Member Larry Freeberg moved to adopt Ordinance No. 26-011; Council Member Logan Cruz seconded. The motion carried 4-0-0.
Why it matters: the change is intended to simplify permitting for small, ancillary on-site housing that supports businesses—such as a caretaker unit—without opening General Commercial parcels to conventional residential development.
The ordinance will be incorporated into the Town's Land Management Code and staff will update permit checklists and guidance to reflect the new permitted use.
