The Rutland City Council voted March 9 to offer the tax‑forfeited property at 113 First Street for sale by sealed bids, with bids due by noon on April 6 and no minimum bid required.
Council member Hoflen moved the sale, seconded by Council President Erickson; the motion carried. The council directed that bids be opened at the Council meeting on April 6 and followed by an auction, and set sale terms requiring cash payment and “substantial improvements” to the property within six months.
Council member McLaen told the council the roof has caved in on the front portion of the building formerly occupied by the Post Office, which the city purchased after tax forfeiture. The Auditor will publish a sale notice in The Teller for two consecutive weeks, with the last publication at least ten days before the sale, to satisfy NDCC 40‑11‑04 to 40‑11‑04.2.
The decision means the city will transition responsibility for repairs to the eventual buyer if the sale proceeds; council members did not set a minimum bid or cap on bid amounts. The sealed‑bid deadline and the auction at the April meeting establish the council’s timeline for transferring the property.
Next step: the Auditor will publish the required legal notices and accept sealed bids through noon April 6; the council will open bids and conduct an auction at its April meeting.
