Gordon County Planning Commission approves multiple variances and rezonings; denies one unpermitted-structure variance

The Gordon County Planning Commission on June 8 approved a series of variances and rezoning requests and denied one variance for a structure built without permits.
Chairman Randy Rule opened the meeting in the Assembly Room of the Gordon County Judicial Building and the commission unanimously approved the minutes from its May 11 meeting before taking up land-use items.
The commission granted conditional use permit CUP-2026-002 to LJ Farm, LLC, allowing the expansion of an existing poultry operation in the A-1 zoning district from six poultry houses with approval to construct four additional houses on the same property. Commissioner Dianne Kirby made the motion to approve, which carried unanimously.
A variance request (VAR-26-4) from Donna May Naylor and Thomas Clyde Bordovsky to allow a structure already built without zoning verification or building permits to remain approximately 3 feet from the side property line was denied. Chairman Rule moved to deny the request, Tommy Hibberts seconded, and the motion carried with three votes to deny and Dianne Kirby abstaining.
Other variances approved and recommended to the Gordon County Board of Commissioners included: - VAR-26-6 (Montana and Amy Patterson): permission to divide a 10-acre tract for a family member while retaining road frontage for the parent parcel; commissioners noted the lot’s buildable area is constrained by an on-site floodplain. The commission voted to recommend approval. - VAR-26-7 (Earnest Lawrence): approval to leave an above-ground pool in the front yard because the lot lacks a side or rear yard. Lawrence told the commission that "the pool company installed the pool while he wasn't home." The commission voted to recommend approval. - VAR-26-8 (TBCH Investment Group / applicant Tommy Richardson): a 16-foot encroachment approval on a very steep lot; recommended to the Board of Commissioners. - VAR-26-9 (Derek and Brandon Champion): permission for a shared driveway to access a 1.72-acre family-transfer parcel created at the rear of a lot with only 20 feet of road frontage; recommended to the Board of Commissioners.
The commission also recommended approval of several rezoning requests to the Board of Commissioners, including: - RZ-26-29 (Jeff Dyer): divide ~3.51 acres from a 9.91-acre tract and rezone the divided portion from A-1 to RA-1 for a single-family home. - RZ-26-30 (Natlie Newman and Ricky Vaughn King): combine two half-acre parcels and rezone to R-6 so the existing residential use conforms to the county’s Unified Land Development Code (ULDC). - RZ-26-31 (Mark and Judy Gazaway): rezone 2 acres from A-1 to R-1 to create a legal lot around an inherited residence. - RZ-26-32 (Country View Estates / Gloria Treadaway Hunt): rezone ~43.74 acres at 1232 Sugar Valley Road to develop a 16-lot residential subdivision (1-acre minimum lot sizes); the commission approved the request 3–1 with one abstention. - RZ-26-33 (Derek and Brandon Champion): rezone 1.72 acres from A-1 to R-1 as a family transfer to create a residential homesite; recommended to the Board of Commissioners. - RZ-26-34 (Al Hopper and Benjamin Hopper, Trustee): rezone from A-1 to R-1 to add a single-family home and bring the parcel into compliance; recommended to the Board of Commissioners. - RZ-26-35 (Aladdin Manufacturing Corporation): rezone from I-1 to I-2 to align zoning with long-standing industrial use across parcels; recommended to the Board of Commissioners.
All adjoining property owners were notified for the items listed. The meeting was adjourned at 7:37 p.m.; Secretary Charmon VanDyke attested to the minutes.
Next step: all recommended approvals will be considered by the Gordon County Board of Commissioners; the denied VAR-26-4 will not be forwarded for approval.
