Engineers deliver private-street maintenance declaration for Bluestone Drive; town asked to place on Aug. 7 agenda

Greenway Engineering transmitted a declaration dated July 25 from Bluestone Industrial Development, LLC describing proposed private-street maintenance arrangements for the Bluestone Commercial and Industrial Park and requested that the town place the declaration on the Aug. 7 Council agenda for review and possible action.
The declaration identifies the developer (the Declarant) and provides for an association (the Bluestone Commercial and Industrial Maintenance Association) to assume responsibility for construction, maintenance, repair and reconstruction of private streets and associated stormwater management facilities. The document specifies annual assessments to cover operational and capital expenses and reserves temporary construction easements along lots fronting private streets to allow the Declarant and the Association to maintain and repair the streets. The letter and attachments were provided to the town attorney for review and to be scheduled for Council discussion on Aug. 7.
The transmittal noted that the Declarant would construct the private streets to applicable Town standards and that the Town, Frederick County and VDOT would have no obligation for construction or maintenance of those private streets, per the declaration language included in the packet.
Council did not take action on the matter at the July 3 meeting; the letter requested placement on the Aug. 7 agenda for further discussion and potential consideration.
