Councilors voted to remove Section 14 in its entirety and to delete the final sentence of letter c — language that referenced a city-code provision on agenda placement — after brief debate about redundancy with state law and notice access for older residents.
The measure, introduced as Resolution 2024-23, was opened for discussion before a motion to approve the amended version was made and seconded. "We accept resolution 2024-23... remove section 14 in its entirety and amend number 2, letter c to delete the last sentence," a councilor moved during the meeting. A second councilor formally seconded the motion.
During discussion, one councilor cited state law and an attorney-general opinion while urging caution about repeating statutory language in a local resolution. "2023 New Mexico State statute ... section 3-12-3 ... and ... attorney general number 7-71-46. That's the law," the councilor said, arguing the resolution should not duplicate existing statutory requirements. Another councilor objected to removing the word "post office" from the list of notice options, saying many senior residents rely on physical postings and may not check internet postings regularly.
After clarification of the exact edits to be made — deleting Section 14 and removing the final sentence beginning "pursuant to the City of Ruidoso Downs code of ordinance section 31.02" from letter c — the council conducted a roll-call vote. Councilors answered in the affirmative when called and the motion carried. The clerk recorded the approvals and the mayor declared the motion adopted.
The council took no other substantive public comments during the meeting and then adjourned. The resolution as adopted changes the city's published meeting-notice wording as described; the full, amended text will be available in the city clerk's office or on the city's public records as part of the official meeting record.
