Planning Commission flags code violation at 12700 Chapel Road; owner given short remediation schedule

The Clifton Planning Commission told the Town Council on Sept. 3 that it had found a violation of the Town Code (Chapter 11, CBLAD rules) at 12700 Chapel Road.
Planning Commission representative Kathy Kalinowski said the owner of the property, Marcus Silva, had begun a parking-lot disturbance in excess of 2,500 square feet without filing a plan of development, an erosion-and-sedimentation (E&S) plan or a water-quality impact assessment, and "has commenced measures to prevent runoff on the property and has agreed to schedule to meet the requirements of the ordinance as set forth in his email of September 3, 2013 to the Planning Commission." Kalinowski relayed the remediation timeline presented to the commission: an E&S plan to be prepared by Sept. 13 and a site plan by Sept. 17.
The Planning Commission recommended the Town Council note the violation. Councilor Bill Hollaway moved to approve the recommendation and John Powell amended the motion that the report be noted in the record; the council unanimously approved the motion.
The council did not take enforcement action at the meeting beyond recording the violation and the remediation timetable; the Planning Commission will monitor follow-through on the schedule.
