Energy advocates, large customers and laborers secure settlement commitments in Montana PSC merger docket

The Joint Energy Advocates — represented by the Northwest Energy Coalition, Renewable Northwest and the Montana Renewable Energy Association — filed a stipulation that (1) asks applicants to improve the rigor and transparency of integrated resource planning and to evaluate coordinated transmission and generation opportunities, (2) directs the merged utility to convene a focus meeting on expanding demand‑side resources and (3) secures the right for the Joint Energy Advocates to nominate one qualified representative to Northwestern’s Electric Technical Advisory Committee (ETAC). Benjamin Otto, the JEA witness, said the package ‘‘moves the ball forward’’ on stakeholder access to planning.
The Large Customer Group (LCG) described a separate stipulation that includes commitments on maintaining strong balance‑sheet practices, restrictions or disclosures tied to dividend policy and a commitment that existing ring‑fencing protections remain in force for Northwestern after closing except as addressed by the settlement’s specific mechanics. LCG witness Michael Gorman told commissioners these assurances were material to large customers that rely on predictable reliability and competitive prices.
Laborers Local 1686 presented settlement terms addressing the local construction and pipeline workforce: Northwestern agreed to implement a local‑hire evaluation in contractor bid scoring for Montana projects, provide market‑wage certification for larger natural‑gas and generation projects, give positive consideration to use of registered apprenticeship or equivalent workforce training programs, and produce post‑award wage and workforce reports followed by an annual review meeting. Laborers’ business manager Adam Haight said the reporting and verification elements are intended to ensure the commitments are implemented; the labor provisions in the settlement terminate on December 31, 2030.
All three intervenor settlements were admitted into the record with witnesses made available for commission questioning. Each witness testified they would support the merger if the commission records those commitments and holds applicants accountable to implement them if the merger is approved.
