CPMT rejects enCircle amendment request to attendance-payment terms, asks provider to meet June 22

CPMT members reviewed a requested amendment from provider enCircle (Minnick) to change payment and attendance language in the Tazewell County CPMT Service Agreement for private day school services. enCircle sought to replace the existing absence-payment terms with a clause referencing Virginia attendance laws (citing § 22.1-258 and 8VAC20-110-130) and stating a student would be discharged after 15 consecutive absences and the buyer would pay through the point of discharge.
enCircle representatives Terri Webber and Ashley Wittl-Osborne were scheduled for an 11:00 a.m. in-person appearance but did not attend in person; the coordinator received a call from Ms. Webber saying she could attend virtually. CPMT elected not to take the phone call during the meeting to keep to the agenda and instructed the coordinator to reschedule the provider for the June 22, 2026 CPMT meeting at 11:00 a.m.
A motion to leave the Service Agreement language unchanged was made by David Taylor and seconded by Jeff Brintle; the motion was recorded as unanimously passed. CPMT therefore denied the requested amendment at this meeting and scheduled the provider for a future discussion.
The existing Service Agreement language in the packet specified paying the provider for up to seven days of absences per semester (14 per academic year) for non-residential private day school services, with excused absences allowed beyond those limits, and a separate rule limiting payment for only five unexcused absences per year before truancy provisions apply.
