The Defiance City Council unanimously adopted an ordinance on third reading Tuesday to vacate a small strip of city right-of-way adjacent to Jackson Enterprises Limited.
The clerk read the caption for the ordinance described in the meeting as vacating a strip of right-of-way between the Maumee and the Augways Rivers in the City of Defiance. Council member Corbett moved to adopt and Council member Mast seconded the motion.
The clerk conducted a roll call. Council members Inga, Wexler, Mast, Crouch, Hancock, Kaufman and Corbett voted yes. "With that, this ordinance is adopted," the chair said after the affirmative roll call.
According to the presentation, survey work showed an existing building on the Jackson Enterprises property encroaching on Jackson Avenue; the council approved vacating about 0.062 acres to resolve the encroachment. The item was described during the meeting as the third of three required readings under the cited municipal code section.
The ordinance caption and the river name were read as transcribed during the meeting; the clerk did not supply an ordinance number during the reading. Council did not discuss amendments at the session. The council adjourned following the vote.
