Pelletier board urges permit, tougher enforcement after noisy unpermitted car event

The Town of Pelletiers board on March 9 heard from Code Enforcement Lieutenant Chris Jensen about a recent unpermitted car event whose amplified bass shook windows across neighborhoods and prompted multiple complaints.

Jensen said the event drew out-of-town organizers and speakers at the meeting said there was no existing special-event permitting process for shows of that scale. "There was no permitting process for a thing like that within the town," Jensen said, adding that deputies had trouble applying the towns noise rules because some officers were relying on an older standard.

Staff and commissioners discussed enforcement tools already in the town ordinances. A staff member noted the nuisance/noise article carries a $50-per-occurrence civil penalty and that repeat violations may rise to a misdemeanor under a provision cited in the discussion as "14-4." Town staff cautioned that decibel-based enforcement can be difficult without measurement evidence, and suggested a permit scheme that would create clearer expectations and additional leverage for enforcement.

Commission members asked whether the town could recover legal fees from violators; staff said they would research statutory authority and return with recommendations. The board directed staff to draft proposed permitting language for future special events and to send an initial notice to the organizer warning that further violations could prompt criminal charges or stiffer civil enforcement.

Next steps: staff will research whether the town may collect legal costs, draft permit/fee language and send notice to the event organizer. The item was discussed as a staff-directed follow-up; no ordinance amendment was adopted at the meeting.
