Mount Orab council stalls on picking replacement; mayor outlines special meeting and 30-day deadline

Mount Orab’s council said it could not reach agreement on who to appoint to a vacant council seat and outlined next steps, including a special meeting and the possibility of a mayoral appointment if the council does not decide within 30 days.

The mayor told the council he planned to convene a special meeting to take a vote once the absent member returned and said that if the body cannot identify a candidate with the required votes before the 30-day statutory window closes he will make the appointment himself. “My plan is to try to hold another special meeting just for this voting once the other council member is back in town and available,” the mayor said.

A council member cited state law during the exchange, saying, “Under Ohio law, council has 30 days within which to make a decision. Should council not make a decision, then that power falls to the mayor to make an appointment.” The member noted that if the mayor also fails to appoint, the matter could be taken to court for resolution.

Why it matters: The council’s inability to coalesce means the village could see the vacancy filled by mayoral appointment if members cannot agree, shifting the selection process from a council vote to an executive decision. The council has the option to reconvene and amend or repeat votes during the 30-day period.
