The committee granted the Department of Motor Vehicles a waiver of timing requirements and postponed consideration of rule 26-11 to the October meeting to allow the department to incorporate a recent statutory change into its safe‑vehicle requirements and to reissue public notice.
Staff said the rule package had changed substantially since the committee last saw it and that the department intends to merge two processes created by the new law; director John Marasco and Deputy Director Melissa Riley said they will file a special notice and host another public hearing to cure notice issues. The department and staff said the October 15 scheduling allows the full public‑notice period the committee prefers — approximately equivalent to starting anew with a 21‑day notice and full comment period.
Representative Leon, who participated in the working group, thanked the DMV for pursuing additional public vetting. The motion to grant a waiver and postpone the rule passed by voice vote.
The DMV said it also will make editorial and substantive adjustments to limit the rule to road‑safety inspection items rather than vehicle component/parts requirements, per committee requests.
