Council pauses on Lost River 8th edition pending geotechnical confirmation; city warns of liability

City counsel and staff explained the issue: a geotechnical stability report completed roughly 10 years earlier covered the area, but the firm that produced that report was acquired and the successor firm declined to simply sign off without performing a new review. Lucas (city legal/planning staff) told council "If the city accepts that previous report, the liability is shifted to the city, because that previous report is not being supported by anyone at this time."
Staff said the planning commission had included a condition tied to the earlier report when it approved a prior plat, and the city wants an outside party to confirm whether the older analysis still applies given changed river-channel conditions after the FM diversion project. Council members and staff discussed options ranging from asking the successor firm to provide a summary letter to ordering a new geotechnical study; staff committed to compiling requested documents, including the original report, ID agreement and covenants, and bringing the matter back for council review.
No new determination was made at the meeting; council directed staff to return with the requested documents and recommendations at a future meeting (staff suggested April 20 as a return date), and several members stressed the city's interest in managing liability and in protecting residents and developers.
