Council discusses clearer rules for right‑of‑way improvements and vegetation after safety complaints

Councilors spent a lengthy portion of the July 14 meeting discussing improvements placed in town right‑of‑ways and vegetation that obstructs sightlines at intersections.

The chair opened the discussion noting multiple resident complaints about landscaping and hardscape placed close to the road and said state statutes provide a default enforcement mechanism when a municipality lacks a local ordinance. "When I did check with state of Indiana and Indiana ordinances, the general ordinance… if we don't have our own ordinance, it defaults back to the state's ordinance," the chair said.

Councilors debated enforcement options, including sending warning letters to homeowners and measuring problem areas before escalating enforcement. One councilor said some vegetation has grown for 25 years and "it's going to be a little ugly in a few spots," urging focused enforcement on the most flagrant violators. Members discussed potential town liability if the town selectively enforces an ordinance and how deed or right‑of‑way rules apply to hardscape and plantings that might damage town equipment.

The building commissioner and road commissioner weighed in on safety and equipment risk; councilors suggested a staged approach of notice, a reasonable compliance window and follow‑up removal when property owners fail to act. The council also noted that specific clearance measurements are addressed in existing town ordinances and that further ordinance text or diagrams might help clarify expectations for residents.

Councilors asked staff to prepare guidance and consider updating local ordinance language and enforcement procedures to make responsibilities and consequences clearer for residents and for town operations.
