Pottawattamie County — The Board of Supervisors authorized the board chair to sign an engagement letter with Dorsey & Whitney LLP to update the county's urban renewal plan and draft a development agreement related to the JJHP LLC development.
County staff explained recent state law changes affecting tax-increment financing (TIF) and the treatment of low- and moderate-income (LMI) withholdings. Planning staff said historical LMI withholding in the county would have been approximately 46% of TIF funds under the older approach; the legal update is intended to ensure compliance and update timelines and payout provisions in the development agreement.
The board approved the engagement by motion and voice vote. Staff said the engagement authorizes Dorsey & Whitney to draft the revised development agreement and related documents; the development agreement itself is expected to be drafted and returned to the board for review once the attorney's draft is complete.
