The Planning Board continued a two‑lot subdivision application from JJ Lamb’s LLC for 244 Main Street to Aug. 19 after abutters raised what they described as material title and notice deficiencies.
Tom Schonberg of SEC Associates described the proposed two‑lot subdivision and noted pending NH DOT and subdivision approvals. Attorney Sean Dunphy, representing the applicant, said his office reviewed title and the confirmatory deed and that the survey and deed description are accurate.
Several abutters asked the board to not rely on the present materials without clear recorded instruments supporting a roughly four‑acre rear boundary that appears in the applicant’s plans. James Mosher told the board that a confirmatory deed cannot create title to land that the applicant did not previously own, and said the board should deny the application if documentary support could not be produced. Kimberly Raymond likewise asked the board to identify which recorded instrument supports the disputed acreage and to explain what town counsel has reviewed.
The applicant’s attorney said deed and survey work had been done and suggested legal remedies exist outside the planning‑board process for title disputes; the board decided to continue the application to allow engineering review and to give staff and parties time to assemble title materials and counsel review.
Next steps: the application is continued to the board’s Aug. 19 meeting to allow engineering review and any supplemental title or notice documentation to be submitted.
