The Midway City Council on July 7 adopted Ordinance 2026‑19 approving the annexation of a 2.23‑acre parcel owned by the Grant B. Kohler Trust at 970 North River Road.
Staff said the parcel will be zoned RA‑1‑43 and that the annexation will permit one single‑family dwelling while preserving the property’s rural character. Required conditions included dedication of required water rights to Midway before the subdivision plat is recorded, a prohibition on an additional driveway onto River Road (the lot will use an existing private driveway), payment of a park annexation fee ($1,313.71), and an 85‑foot setback from River Road for all new structures. The Council’s findings also noted compliance with annexation code intent and the city’s general plan goals for preserving open areas.
During the public hearing, the applicant’s representative requested a reduced setback; Council discussion considered alternatives (75–85 feet or a variable line) but the Council ultimately adopted an 85‑foot setback. Council Member Lisa Orme recused herself from the discussion and vote because of a family relationship with the property owners. The Council then approved Resolution 2026‑17 adopting the annexation agreement.
Staff noted that future subdivision design would address detailed setbacks and utility requirements, and that the Midway Sanitation District and Midway Irrigation Company requirements must be met by the petitioners before final recording.
