Planning Board conditionally approves reopening of Route 9W diner as catering facility, refers sign variance to ZBA

The Planning Board on Nov. 6 granted conditional site-plan and ARB approval to reopen a former diner at 5500 Route 9W as a catering facility (Route 9W Catering Facility, project 25-28), subject to conditions concerning signage and outstanding engineering comments.
Applicant representative Ross Winglovitz and owner Renice Marley described interior changes, site repairs and a plan to use existing driveways. Code Compliance noted the building's sprinkler system and accessible parking; Pat Hines said the Orange County Planning Department issued a local determination with no county-wide impacts and that the DEC sanitary sewer permit provided is valid. The board discussed a proposed freestanding sign that exceeds height and setback limits; Dominic Cordisco said the project could be approved subject to either removing the freestanding sign or obtaining required variances from the ZBA prior to a certificate of occupancy. "That would be an acceptable condition to us," Cordisco said.
The board voted to waive a public hearing, authorized a referral to the Zoning Board of Appeals on the sign, and approved the conditional site plan and ARB design subject to addressing outstanding engineering comments, paying fees and resolving the sign condition before issuance of a CO.
