The Town of Newburgh Zoning Board of Appeals approved an area variance allowing a 28×24 accessory garage with a 21.52‑foot height at 6 Barbara Court, with the condition that the structure remain a non‑habitable garage and storage area.
Applicants Karen Williams and David Arrotta described plans for a prefabricated garage intended for storage rather than living space. Chairman Darrin Scalzo said his primary concern was the height and the potential for future finishing of the space; he asked for a clear condition that the structure not be occupied.
"It is not an ADU. It's a garage," Williams told the Board. Counsel and the Board noted that any future schemes to add insulation, heating, or water would require revisiting the Board. The Board approved the motion with the condition explicitly included in the motion, and Siobhan Jablesnik recorded a unanimous roll call in favor.
