Enoch council approves Boots Frei development agreement, accepts 25-acre donation pending clarified language

City Attorney Justin Wayment identified a circular sentence in Section 10(b)(i) addressing transfers of density and recommended revising the provision so staff-level administrative modifications are distinguished clearly from substantial amendments that require legislative action. Wayment also advised the Council that the agreement cannot legally bind future councils to extend density patterns to properties beyond the agreement’s boundaries.
Council members discussed Section 12 of the agreement, which provides for the developer to donate 25 acres to the City. The donation was characterized during discussion as the primary developer commitment; the agreement does not obligate the developer to make specific improvements to the donated acreage. City Manager Ryan Robinson added that infrastructure, including a pressurized irrigation pipeline, is scheduled to extend to the end of the property under the developer’s agreement with Public Works leadership.
Council Member Jacob Miner moved to approve the Boots Frei Development Agreement; Council Member Kimberlee Trower seconded. The roll-call vote recorded Council Member Debra Ley: Yes; Council Member Kimberlee Trower: Yes; Council Member Jacob Miner: Yes. Two members were absent. The Council agreed the clarified contract language would be returned for confirmation following the attorney’s edits.
The Council’s action accepts the agreement subject to the clarified language and secures the land donation as pledged in the draft agreement; staff will present the amended language for final confirmation.
