The Montana Public Service Commission unanimously approved an updated notice of proposed rulemaking on April 28 to implement the utility planning and solicitation provisions of 2025 House Bill 55.
Amanda Webster, the commission's chief legal counsel, told commissioners the updated draft is the same as the version the commission approved two weeks earlier but includes highlighted updates — statements of reasonable necessity — that explain why each amendment is needed for publication. Webster said there are no substantive changes to the proposed rules and that the hearing has been moved to Tuesday, June 2 at 10:00 a.m.
A commissioner moved to approve the updated draft and authorize staff to make clerical edits and file the notice with the Montana Secretary of State. The motion was seconded and passed unanimously; several commissioners thanked legal staff for catching omissions that needed correction in the prior notice.
The rulemaking will adopt amendments pertaining to utility least‑cost planning, competitive solicitations for electric resources and the new independent evaluator process created by House Bill 55; the commission directed staff to file the updated notice for publication in the Montana Administrative Register.
