During the public-comment period on April 27, resident Timothy Casias told the Eunice City Council he intends to serve documents alleging constitutional violations by the city and its officials.
Casias said he recently filed a federal case in the Northern District of Texas (Abilene Division) and referenced Noble v. City of Eunice (2023), which he said put the city on notice about similar claims. He said a city records response to his request stated: "No responding records were found. The City Manager position is a contractual position and the City Attorney as well," and he argued that under the New Mexico Constitution appointed officers must take oaths of office.
Casias told the council he filed a civil RICO case in federal court and provided the case number as 1:26-CV-00024-H-BU. He said he would serve the city with documents showing alleged violations in ordinances and customs practices, and that he expects to include additional claims drawn from city records. Casias also named city Ordinance 3301 in his remarks as an example of the city's practices he intends to challenge.
There was no substantive response recorded from council during the public comment; the record shows his three-minute comment concluded and the meeting proceeded to department reports. The claims raised by Casias in public comment remain allegations; the council took no official action on them at the April 27 meeting.
