Lockport extends occupancy deadline for Lockport Square Lot 6 annexation agreement

The Lockport City Council voted to approve a fourth amendment to the annexation agreement for Lockport Square Lot 6 that extends the occupancy requirement to April 30, after staff said the self‑storage project is significantly underway.

Mr. Carroll, the city's pro tem, explained the amendment was limited to extending the occupancy date and that staff had asked for the item to go directly to council because the existing annexation agreement would expire before the next scheduled meeting. "They're only asking us to extend the occupancy requirement date and the annexation agreement to April 30," Mr. Carroll said, noting staff's observation that construction was substantially underway.

Council members closed the public hearing after asking for public comment; no members of the public spoke and the applicant (Jacob Development) did not appear. The move required a two‑thirds vote because annexation agreement amendments are governed by that threshold; the council confirmed a sufficient number of elected officials were present, moved to pass Resolution 26082, and approved it by roll call.

The amendment changes the occupancy trigger in the annexation agreement; staff said construction progress indicates the applicant expects to finish by April. The council did not impose additional conditions during the hearing, and staff recorded the vote and closed the meeting following passage of the resolution.

The council reconvened after a short recess and handled the public hearing and vote during the same meeting session; procedural checks about the reconvening vote were raised and resolved on the record before the annexation vote was taken.
