Select Board waives tax-deed deadlines for six timeshare parcels to allow further review

The Lincoln Select Board voted to waive tax-deed deadlines for six parcels, including four mountain-club timeshare units, and set a uniform waiver date of May 4, 2027, to give staff and the town’s attorney additional time to pursue probate and lien work.

Staff member said the town has received recent payments from Scott Downs and Mary Huntoon but that several mountain-club units remain delinquent and are entangled with HOA dues and unclear lien records. “So I’m specifically requesting deed waivers for those two just to give him more time to push that one case through probate,” the staff member said, describing attorney involvement on two properties.

Board members discussed trade-offs between waiving the deeds — which can let owners sell and pay the arrears — and taking tax deed ownership, which could leave the town responsible for HOA fees while it holds the property. One member noted a prior waiver led to a sale and full payment, and another cautioned about repeatedly extending waivers: “My concern is if we keep waiving, keep waiving, how many years has it been?”

After discussion of outstanding balances, lien status and potential values, a committee member moved to waive the six tax deeds “as presented,” and the board agreed to amend the motion to set the waiver date to May 4, 2027, so all waivers are uniform and staff can continue probate and lien research. Staff said two of the parcels involve deceased owners and will require more legal work.

The board directed staff to prepare the universal waiver forms with the agreed date and to continue coordination with the town attorney on the two probate cases. No dollar-amount vote tally for the waiver motion was recorded in the public minutes.
