The City of Waverly will advance a proposed rental dwelling ordinance directly to the City Council for consideration at its June 9, 2026 meeting, City Planner Robin Caufman said.
Caufman reported the City Council directed staff to move forward with the ordinance and that City Attorney Rhonda Pagel recommended the regulation remain outside the zoning code. Because it is to be adopted outside the zoning code, the Planning & Zoning Commission will not conduct a public hearing on the proposal, Caufman said. Staff will prepare and send notification letters to known rental property owners to inform them of the upcoming council consideration and to provide an opportunity to comment.
Caufman described a tiered enforcement structure included in the draft: the first notice notifies an owner of noncompliance; a second notice reiterates noncompliance and warns of prospective fines; a third notice issues a fine; and continued noncompliance can result in a no‑occupancy enforcement action. The transcript does not record Council action on the ordinance; the next formal step recorded is City Council consideration on June 9.
The Planning & Zoning Commission recorded the update during its May 21 meeting; staff indicated further outreach materials will be prepared ahead of the council meeting.
