Planning commission recommends conditional approval for Penn Home & Farm lot addition

The Salem Township Planning Commission on Sept. 4 recommended approval of a lot-addition request from Penn Home & Farm LLC that would add Lot 1 to the John and Patricia Kilpatrick property (Tax Map No. 57-12-00-021), but the recommendation is contingent on a list of plan revisions and state and township approvals.
Tom Spears, identifying himself as the property owner and sole owner of Penn Home & Farm LLC (attending remotely), presented the application. Resident Ken Brozack questioned whether a recorded right-of-way exists to reach the rear parcel. Township Solicitor Gary Falatovich said the original Garden Courts plan referenced proposed 50-foot streets that were never dedicated or opened and noted there was no recorded reservation of an easement to access the back parcels; Falatovich also said Penn Home & Farm owns an adjacent parcel (57-12-00-0-032) that will provide access to parcel -021.
The commission enumerated technical plan requirements the applicant must satisfy before final approval, including: showing a 30-foot front building setback and 10-foot side and rear setbacks on the plan; labeling the driveway to the Kilpatrick dwelling; adding Mark Drive’s right-of-way width and identification number; displaying pre- and post-subdivision acreage for both properties; identifying any sanitary sewer easements affecting the property; and adding the following required note on the plan: "Penn Home and Farm owns 54 Mark Drive, Tax Map Parcel No. 57-12-00-0-032, access to Tax Map Parcel No. 57-12-00-0-021 from Mark Drive is available through that property." The commission also asked for documentation of Penn Home & Farm LLC’s current registered address and copies of Department of State filings that identify the LLC’s members, and it instructed that the Owner's Certification include the name of the representative identified as the "Sole Member."
On a motion by Paul Holleran, seconded by Connie Mattei, the commission recommended approval subject to those conditions. The motion passed unanimously. Next steps specified by the commission include submission of plan revisions with a revision number and date, and securing any required Sewage Enforcement Officer, township, and DEP approvals prior to final recording.
