Staff summarized the application, which would authorize the surface irrigation of treated domestic wastewater at up to 460,000 gallons per day on about 117 acres in Comal County. The commission found that multiple individuals living in close proximity demonstrated standing and identified relevant and material issues pertaining to human-health impacts, potential effects to surface and groundwater including drinking-water wells, nuisance odor, compliance with siting and buffer requirements, and whether the applicant substantially complied with TCEQ notice requirements.
Commissioners moved to grant the identified hearing requests, deny the remaining requests and requests for reconsideration, and refer the specified issues to SOAH with a standard 180-day maximum hearing duration. The motion passed by voice vote.
