At the July 15 meeting the Texas Commission on Environmental Quality agreed to grant several hearing requests tied to White Rocks Entertainment LLC's application for a new land-application permit (WQ0016547001) in Travis County.
Chairwoman Brooke Popp described the two-step eligibility analysis for land-application permits and said staff would grant contested-case status for Save Our Springs Alliance, The Nature Conservancy (acting in an adjacent-landowner capacity), James and Teresa Bryant, Joseph Cello, John Duncan and Ryan Holting, while denying other requests and a request for reconsideration. The application would authorize disposal of treated domestic wastewater at a daily average flow not to exceed 120,000 gallons per day via a public-access subsurface drip dispersal system on 27.43 acres.
The commission referred issues to the State Office of Administrative Hearings to consider whether the application is complete and accurate; whether the draft permit will protect the health of requesters, plant life and wildlife; whether the draft permit protects surface and groundwater including groundwater; whether siting and buffer requirements and nuisance-odor protections are met; and whether monitoring and compliance-history considerations are adequate. Commissioners set a maximum hearing duration of 180 days.
A motion to grant the specified hearing requests, deny the remaining requests and the request for reconsideration, and refer the enumerated issues to SOAH passed by voice vote.
