Planning Commission recommends two plats to county commissioners; staff corrects CUP status on pending project

At the June 8 meeting in Clear Lake the Deuel County Planning Commission recommended that the Board of County Commissioners approve the Plat of Tract 1 of Lindner Homestead Addition (SW1/4 of Section 35, T117N, R50W) and the Plat for Lot 12A of Shady Beach Addition in Government Lot 7 of the SE½ of Section 4. Zoning Officer Jodi Theisen explained the Lindner plat includes an existing vacant house located within the front yard setback; that structure is nonconforming for front yard setbacks and would require a variance to be replaced or added onto in the future. The Shady Beach replat incorporated corrections to right‑of‑way and ownership boundaries based on a recent survey. Both recommendations to forward the plats to the Board of County Commissioners passed unanimously.

Separately, staff corrected an item in the posted staff report related to a Conditional Use Permit (CUP). Theisen reported that a related rezoning application had been referred to a public vote and failed, leaving the property zoned Agricultural. She said that although staff had discussions with Missouri River Energy Services about the CUP, the office had not received a formal written withdrawal as of the meeting date. Theisen asked that the minutes reflect the correct status. The board acknowledged the correction and noted that, unless a written withdrawal is received before the next meeting, formal action on the CUP will be required at the July 13, 2026 meeting.
