The Village Board approved a nonexclusive communication easement with Route 165 H4 LLC to allow installation and maintenance of underground fiber‑optic infrastructure within the village right of way along 128th Avenue.
Staff said the easement is subordinate to existing and future right‑of‑way uses, does not grant ownership in the ROW, and requires grantees to register with Diggers Hotline, obtain village engineer approval for construction, and indemnify the village for claims arising from the installation. The easement requires grantees to remove or relocate facilities at their expense if public improvements require it and to remove abandoned facilities after six months unless the village approves abandonment in place.
Chad Broxma, representing Route 165 H4 LLC, said the applicant expects to complete construction before frost and pull fiber by the end of October, using directional boring under roads to avoid traffic impacts.
Trustees approved the easement by voice vote.
