Legislative Rule-Making Review Committee approves 42 proposed agency rules, several with modifications

CHARLESTON, W.Va. — The Legislative Rule-Making Review Committee met Aug. 13 and approved 42 proposed agency rules affecting a range of state programs, from hunting seasons and motor vehicle equipment to tax credits and professional licensing standards.

Chairman Senator Rucker called the meeting to order at 9 a.m. and, after a silent roll call established a quorum, the committee adopted its Procedural Rules Governing the Legislative Rule-Making Review Committee on a motion by Delegate Smith.

Phillip Childs, Joint Committee Counsel, summarized abstracts for the committee and answered members’ questions as the meeting proceeded. Delegate Smith asked unanimous consent to consider an initial group of agency rules simultaneously; the committee granted the request and approved that group as filed. Childs then presented additional individual items (numbered 23 through 42 in the record). On motion of Delegate Smith, the committee approved those rules, either as filed or as modified after agencies agreed to committee-proposed changes.

Among the items approved as filed were the State Tax Department’s Soft Drink Tax rule (110 CSR 19), several Offices of the Insurance Commissioner rules (including 114 CSR 07, 114 CSR 09, 114 CSR 10), continuing-education standards for the West Virginia Medical Imaging and Radiation Therapy Technology Board of Examiners (18 CSR 02), motor vehicle equipment standards (91 CSR 11) and hunting-related rules from the Division of Natural Resources (58 CSR series).

Several rules were approved as modified after committee review and agency concurrence. Those included credit-for-reinsurance provisions (114 CSR 40), agricultural standards and licensing (61 CSR 08; 61 CSR 11H; 61 CSR 40), mine-subsidence insurance (115 CSR 01), cyber reporting requirements for the Office of Technology (163 CSR 03), and professional-board rules for medical imaging and occupational therapy (18 CSR 01; 18 CSR 05; 13 CSR 04). Amy Minor, assistant commissioner with the Department of Agriculture, and Jamie Browning, executive of the Medical Imaging and Radiation Therapy Technology Board of Examiners, each answered committee questions before their agencies’ rules were approved as modified.

The committee’s actions were procedural approvals of proposed agency rules; the record does not show roll-call vote tallies, only that motions to approve were adopted. Chairman Rucker announced the committee will meet next on Sept. 10, 2025. With no further business, Delegate Smith moved to adjourn and the committee did so.
