Neighbor alleges contamination risk at 455 Middlefield; Land Use cites appeals and staffing limits

The mayor's Code Enforcement Committee on Sept. 25 discussed longstanding complaints about properties at 455 and 465 Middlefield Street and a neighbor's written allegation that a new landscaping business operating at 455 is creating contamination risk.
The chair summarized an email from neighbor Kathy Dwyer saying Anita's Landscaping recently began operating at 455 Middlefield and that landscaping activities on unpaved surfaces "bring a high risk of oil fertilizer runoff" into the river; Dwyer "alleges 20 year plus years of violation" and criticized enforcement gaps. Committee members said departments have gone out repeatedly in the past but that enforcement authority has limits.
Tom (Land Use staff) said several violations are on record, one zoning violation (a junkyard determination) is under appeal in superior court and that he has asked Donna Parker for guidance on whether to pursue an administrative search warrant or another route to verify compliance. Tom also said he would "put it on a route" for inspection and is awaiting Parker's response.
Kevin and other staff noted complaints often describe after-hours activity; the staff lacks the capacity for routine after-hours surveillance. Staff asked neighbors to report suspected violations in real time so inspectors can respond. The committee recommended removing items from the active agenda where no recent enforcement developments exist and to restore items if new violations arise.
