Montreat board opens hearing on zoning text amendments tied to 2023 laws, delays adoption to Oct. 10

The Town of Montreat held a public hearing on Sept. 12 for TA-2024-04, a proposed text amendment to Sections 300, 301 and 309 of the general ordinances intended to bring local rules into compliance with recent state legislative changes.
Zoning Administrator Kayla DiCristina told the board TA-2024-04 "is a request to amend the general ordinance to comply with legislative updates from session law 2023-108 and 2023-137," and said the UNC School of Government provided guidance on the revisions. She noted that on Sept. 11 the legislature overturned the governor's veto of bill 166, which affected proposed changes under section 309.
Town Attorney Brandon Freeman said he had reviewed the legislature that morning and, after further consultation with staff, advised the board to allow more time to incorporate a minor change needed because of the recently enacted law. Commissioner Jane Alexander moved to continue the discussion to the board's next regular meeting on Oct. 10; the motion passed 5–0.
No ordinance adoption occurred at the Sept. 12 meeting. The board opened and closed the public hearing with no public comments recorded in these segments. Staff and legal counsel will return with revised language at the Oct. 10 meeting for further consideration.
