Westchase board waives some fines, imposes others and enacts suspensions

The Westchase Community Association Board of Directors voted on multiple owner appeals and covenant fines at its Sept. 5 meeting, waiving some penalties, denying others and approving fines with temporary suspensions of association facility privileges.
Terry Boyd moved to waive the $1,000 fine for O-1 (10442 Lightner); Rick Goldstein seconded and the motion carried 7-0. Boyd then moved to deny the appeal for O-2 (10731 Tavistock); that motion also carried 7-0. For O-3 (11813 Middlebury) Boyd moved to table the $1,000 fine to the October board meeting pending the lights being re-angled downward; Michele DelSordo seconded that action. Boyd moved to waive the $1,000 fine on O-4 (11813 Middlebury); Rick Goldstein seconded and the motion carried 7-0.
On a broader set of enforcement items the board voted 7-0 on several motions. The board voted not to impose fines on a list of items (T-1, T-2, P-1-4, 6, 7, 9-12, 15, 17, 18, 20, 21, 24-27). The board also voted to impose $1,000 fines on P-5, P-8, P-13, P-14 and P-16 and to suspend those residents’ use of Westchase Community Association facilities for a maximum of 90 days; the first day of suspension was set as the fifth day after confirmation by the Covenant Committee. The board additionally imposed $500 fines on P-19, P-22 and P-23 with the same suspension terms. All of these enforcement motions were moved by Terry Boyd and seconded by Rick Goldstein and carried 7-0 as recorded in the minutes.
The board also voted to reverse an August fine motion affecting 10223 Woodford and tabled that matter to the Oct. 10 board meeting. The minutes do not record appeals hearings, written submissions or residents’ statements beyond the motions and outcomes.
