The Town of Newburgh Planning Board on Jan. 15 reviewed an amended site plan and special use permit application from Cannabis Huts for a retail cannabis dispensary at 5306 Route 9W and voted unanimously to prepare a referral to the Zoning Board of Appeals for necessary variances.
Applicant attorney Joseph Saffioti told the board the project would repurpose an existing empty office in the Valero/Route 9W building and that the only exterior change would be converting a front window to an entrance. "We are here tonight for a repurposing of an existing empty space in an existing structure," Saffioti said.
Project planner Patricia Brooks said the previously proposed EV charging station work is not moving forward, so the team will file a fresh ZBA application for area variances tied to the dispensary proposal and will provide the narrative items required by code Section 18548.9(C)(1–5). Brooks asked whether variances and the site plan could proceed concurrently; Planning Board attorney Dominic Cordisco advised a new referral would be required.
Code compliance and engineering staff flagged additional requirements: Jim Campbell asked for specific dimensions tied to storefront width and freestanding sign height and placement, and measured the daycare buffer, noting, "You are over 500 feet," in confirmation that the proposed dispensary meets the daycare separation requirement. Pat Hines said county referral is required because the site fronts a state highway and that ARB review is required for signage.
After discussion, the Board voted (motion by David Dominick; second by Lisa Carver) to have Planning Board attorney Dominic Cordisco prepare the ZBA referral for the variances. The motion passed on a unanimous roll call vote.
Next steps identified for the applicant included preparing the ZBA referral, supplying sign dimensions and store frontage measurements, and submitting any required ARB and county referrals.
