Staff said the applicants sought to amend existing site plans because the current plans did not show incidental display areas, a technical requirement in the zoning code. Philip, the operations manager for Tex Team USA LLC — the applicant representative — told commissioners they were applying to place three donation boxes at each Kroger location and to formally identify the seasonal display area so the properties conform to code. “We’re applying to place 3 donation boxes on the Kroger marketplaces in your city, and we’re trying to make everything as required,” he said.
Commissioner Hageman dissented on the first Kroger decision and voiced concern about donation bins becoming dumping sites. “I don’t like the donation boxes. I think they’re trashy. I think people leave all kinds of stuff there,” Hageman said, urging caution before granting blanket approval for front‑door displays. Other commissioners countered that approving the delineated display area would allow code enforcement to bring existing activity into compliance and keep the front‑door placement tidier than back‑lot locations.
Staff stressed that some of the display area already exists in practice and that the amendment’s purpose was to map and regulate that activity. Commissioners also noted that donation boxes are allowed by right in some configurations and that the approval focused on where incidental display would be permitted rather than who operates donation bins.
The commission approved SP2024‑035 for the Kroger South location (vote recorded as 5–1 with one commissioner dissenting and one absent) and approved the near‑identical SP2024‑036 for the Kroger North location (also recorded 5–1). The record shows the body sought to balance concerns about litter and visibility with the practical need to formalize what is already occurring at the stores’ entrances.
Next steps: the amended site plans will be processed consistent with city procedures and will be subject to code enforcement and any conditions imposed at approval.
