Planning staff said the property owner owns three combined lots, giving a substantially larger lot area than many residential parcels nearby, and the daycare use and adjacent commercial parcels create unique circumstances that support a limited variance.
Staff and the planning commission recommended four conditions: remove a semi-trailer from the front yard, obtain a building permit for the fence, rebuild a 52-foot existing section so the finished side faces the neighbor and posts face the owner’s yard with required setbacks, and match the fence type along the west property line. The applicant said she would pull the fence in several feet and remove the rear section to address neighbor concerns.
Planning staff noted the requested height exceeds the usual 6-foot limit by 2 feet in the side yard but found the variance minimal and necessary for the daycare’s privacy and safety. Council members asked clarifying questions about dimensions and inspection requirements and then voted to approve the variance with the planning commission’s recommended conditions.
