Planning commission defers developer’s tree‑bank payment request after commissioners cite removed trees and missing applicant

The Fairview Planning Commission on July 14 deferred a developer’s request to make a payment into the city’s Treebank fund instead of replacing approximately 698.5 caliper inches of trees removed at the Crylight/Carlyle Plaza site.

Planning staff told the commission the code allows an applicant to request an exception when trees removed on a site cannot be replaced there and described two options: plant on-site or pay $50 per caliper inch into the Treebank fund. Staff said the deficit totaled 698.5 caliper inches and that the $50-per-inch rate produced a contribution of $34,925; at an earlier point staff had described the payment as “approximately $40,000,” a staff clarification showed.

Several commissioners said the property owner removed trees before seeking the exception, which members said risked setting a precedent of developers clearing sites and asking for forgiveness later. Vice Mayor McDonald said the sequence “feels like a precedent of asking for forgiveness” and several commissioners urged deferral so the applicant could answer questions in person. Staff explained the deficit calculation came from the grading permit, an existing survey and a landscape plan submitted with that permit.

The commission voted to defer consideration until the next meeting so staff could verify the site‑plan history and the applicant could appear. The motion to defer passed by the commission’s recorded vote (motion passes 8-0-1).

Next steps: staff will follow up with the applicant and provide the commission a clearer accounting of the tree-caliper calculation and the landscape plan evidence before the item returns to the agenda.
