Council adopts ordinance updating pool, hot tub and spa rules to match state code

The city council unanimously approved code amendments to Sec. 125-84 to add hot tubs and spas, clarify setbacks and define fencing and gate safety standards to bring the city into conformance with state statute.

Brett, a city staff member, told the council that the proposed ordinance "references swimming pools, hot tubs, and spas, which is really aligned with what state statute has." He said the changes focus on performance standards: placement of the pool and the surrounding concrete pads, clarifying that a 5-foot setback is measured from the property line, and more detailed fencing and gate definitions to resolve longstanding resident confusion.

Council members asked about enforcement for existing noncompliant pools and whether seasonal draining has limits. Brett said properties already out of compliance could be handled through code enforcement (warning letters and citations if necessary) and that state agencies such as the Minnesota Pollution Control Agency or the Department of Natural Resources likely have guidance on where pool water can be discharged; staff offered to follow up with the council on that specific point.

Councilmember (Speaker 2) moved to approve the ordinance and associated resolution; the motion was seconded and carried by voice vote. The ordinance and summary publication resolution were approved as Ordinance 2026-613 and Resolution 2026-667.
