The Mashpee Planning Board voted July 15 to release the final tripartite holdback for the Willow Circle subdivision after town engineering and DPW staff confirmed punch-list items were completed.
Town planner Brian told the board consulting engineer Ed Pesci had inspected the site and concluded the remaining items had been addressed. Brian said he had also spoken with DPW and provided an email confirming DPW’s acceptance of the current condition of the private way should the property ever be considered for town adoption.
Brian described the tripartite agreement and noted the amount on the agreement had been reduced previously from $135,709 to about $79,818; he recommended a motion to release the remaining balance and clear the subdivision from any further obligations under that agreement. The board moved, seconded, and approved the release by voice vote. Members were asked to sign the release and the chair to notarize the form.
Planner Brian referenced the recorded plan (Baxter 9 Engineering and Surveying, modification dated 09/10/2021, last revised 12/13/2021) and the recorded instruments at the Barnstable County Registry of Deeds that underpinned the tripartite release. The board’s packet included Ed Pesci’s email and photos documenting punch-list completion.
Next steps: the release form will be signed and notarized and the board’s secretary will file documentation with the registry as appropriate.
