Los Fresnos — City meeting leaders entered a closed session Monday evening to review candidates for the city manager post and consider options for selecting finalists, but they reconvened and took no formal action, the Chair said.
The meeting opened at 6:01 p.m.; after a short invocation and the Pledge of Allegiance, the Chair announced at about 6:02 p.m. that the body would move into a closed session “regarding personal matters pursuant to Texas Government Code Section 551.074, specifically to review applications, conduct interviews, discuss the qualifications of candidates, and deliberate the selection of a preferred candidate for the position of city manager,” and that the session could include consideration of additional applicants or modification of the candidate pool.
The Chair also said the session would include consideration of “authorization to negotiate an employment agreement with the preferred candidate.” The transcript used the term “unemployment agreement,” which appears to be a transcription error; the Chair’s statement was a reference to negotiating terms of employment if a preferred candidate were selected. The Chair later announced the meeting had reconvened at 7:59 p.m. and said, “At this time, no action is being taken, and we’re gonna adjourn the meeting at 07:59.” The meeting was then adjourned.
Under Texas law, Section 551.074 of the Government Code authorizes a governmental body to meet in closed session to deliberate personnel matters. The Chair’s statements in the public record indicated that personnel deliberations and candidate interviews were the subject of the closed session. The transcript does not show that the body took any vote, authorized negotiations, or finalized a hire during the public portions of the meeting.
