Advisory Plan Commission recommends replat to create Sand Creek pond outlot for HOA

The Chesterton Advisory Plan Commission on July 16 recommended approval of a replat by N2R Development LLC that creates an outlot for an existing wet-bottom pond in Sand Creek Phase B, allowing the homeowners association to own and maintain the pond.
James Cronin, the developer representative, told the commission the pond was originally inside a drainage easement across multiple lots and that the proposed change ‘‘is just breaking that out into an outlot so that it can be dedicated to the HOA.’’ Staff and commissioners said the change clarifies ownership and maintenance responsibilities.
Resident Jackie Tavidas questioned what homeowners ‘‘get out of it’’ and whether the configuration of the pond would change; staff and the developer said the pond’s design would not be altered and the outlot would remove individual lot maintenance obligations. Town staff characterized the action as removing drainage easements from individual lots and consolidating the pond area into a parcel to be controlled and maintained by the HOA.
A commissioner moved to close the public hearing and provide a favorable recommendation for the replatting; another commissioner seconded the motion and the chair called the question. The commission recorded voice votes of ‘‘aye’’ with no opposition recorded and approved the primary replat recommendation.
Commissioners also discussed the secondary plat, the final Mylar documents that will be recorded with the county recorder. Staff reported printed Mylar copies had been prepared and recommended approving the secondary plat subject to the town engineer’s review and approval. A motion to approve the secondary plat was made, seconded and carried by voice vote. Staff indicated the Mylar will be signed after any remaining engineering checks.
The commission’s recommendations will be forwarded to the next step in the town’s subdivision-approval process for final recording and implementation.
