Planning staff recommends violation; commission asks Grosso construction operator to appear after repeated dust and crushing complaints

Town planning staff on July 16 reported recurring complaints about dust and soil migration from the Grosso contractor yard on Pepper Street and recommended enforcement action if mitigation does not stop the nuisance.
Kathleen Gallagher said staff received multiple complaints and that, although the site had installed a wheel‑washing station and repaired its street sweeper, staff still observed dust impacts and material on adjacent properties. Gallagher said the operator had been asked to increase mitigation and that the town’s erosion control reports claimed sweeping and wash measures were being used, but timing and frequency of those measures left recurring impacts.
Gallagher said the contractor is not currently permitted to crush on‑site and that prior commitments included an on‑site wheel wash and increased sweeping frequency. Commissioners said voluntary compliance had not been sufficient and asked that staff issue a violation and require the operator to appear before the commission on Aug. 6 to report progress. The commission directed staff to pursue a violation and to invite the operator to the next meeting for review and possible further enforcement.
Next steps: staff will prepare a violation notice if mitigation does not stop observed impacts and will require the operator to appear Aug. 6 for a progress update.
